At Nizwas IT Solutions, we aim to maintain clear and transparent payment, cancellation, and refund practices for all projects and services.

This Refund & Cancellation Policy applies to website development, WordPress development, SEO, performance marketing, branding and UI/UX design, website maintenance, security, eCommerce development, custom development, and other digital services provided by Nizwas IT Solutions (“Nizwas,” “we,” “our,” or “us”).

By accepting a quotation, approving a project, making a token or advance payment, or purchasing our services, the client agrees to this policy together with our Terms & Conditions and any project-specific written agreement.

1. Standard Payment Structure

Unless otherwise specified in a quotation, proposal, invoice, or written agreement, Nizwas IT Solutions follows the following standard project payment structure:

50% — Advance Payment

50% of the total agreed project amount must be paid before work begins.

25% — Project Milestone

The next 25% must be paid when the project reaches the agreed development, design, or implementation milestone.

25% — Final Payment

The remaining 25% must be paid after final review and before final delivery, migration, deployment, source-file transfer, credentials handover, or ownership transfer, as applicable.

Therefore, 100% of the project payment must be completed before final project delivery or handover.

For certain projects, retainers, maintenance services, SEO campaigns, advertising services, or larger development projects, a different payment schedule may be specified in writing.

2. Token / Booking Amount

Any payment identified as a token amount, booking amount, reservation fee, or project confirmation fee is non-refundable, except where a refund is required under applicable law.

The token amount confirms the client’s intention to proceed and allows Nizwas IT Solutions to reserve project resources, allocate team members, schedule development time, conduct planning, and prepare for the project.

If the client subsequently decides not to proceed with the project, the token amount will ordinarily not be refunded.

3. Advance Payment

Once the project has been confirmed and work has started, the advance payment may be applied toward services including:

  • Project planning and consultation
  • Research
  • UI/UX planning
  • Website design
  • Development
  • Technical configuration
  • Project management
  • Resource allocation
  • Server/environment setup
  • Plugin/theme configuration
  • SEO research
  • Marketing preparation
  • Other work associated with the project

Payments relating to work already performed or resources already committed are generally non-refundable to the extent permitted by applicable law.

4. Cancellation Before Work Begins

If a client requests cancellation before substantive project work has started, Nizwas will review the cancellation request based on the circumstances of the project.

Any designated token/booking amount remains non-refundable except where applicable law requires otherwise.

If the client has paid an amount above the designated non-refundable token/booking amount, any potential refund of the remaining amount will depend on costs already incurred, resources reserved, third-party purchases made, and other commitments associated with the project.

5. Cancellation After Work Has Started

If a client cancels a project after work has begun, Nizwas IT Solutions will determine the value of work completed up to the cancellation date.

This may include design, development, research, consultation, technical setup, project management, meetings, revisions, integrations, testing, content implementation, and other project activities.

The client remains responsible for payment for all work already completed and authorized expenses incurred.

If the amount already paid exceeds the value of completed work and non-refundable costs, any refund eligibility will be reviewed according to the applicable project agreement and law.

If completed work exceeds the amount already paid, the client may be required to pay the outstanding balance.

6. Cancellation After Design Approval

Once a website design, UI/UX concept, branding concept, development milestone, or other project stage has been approved by the client, payments associated with that completed and approved stage are non-refundable to the extent permitted by law.

If the client later changes direction or requests a substantially different design or solution, this may be treated as additional work rather than grounds for a refund.

7. Cancellation Near Project Completion

If a client cancels a project after the majority of the agreed work has been completed, the outstanding amount corresponding to completed work remains payable.

Cancellation near completion does not remove the client’s responsibility to pay for services already performed.

Nizwas may withhold unpaid project files and deliverables until applicable outstanding invoices are settled.

8. Final Payment & Delivery

The final payment must be received before final project delivery.

Nizwas may withhold items including:

  • Production website migration
  • Website launch
  • Source code
  • Custom theme/plugin files
  • Design source files
  • Website backups
  • Administrative credentials
  • Documentation
  • Server transfer
  • Domain/hosting transfer under our control
  • Other final project assets

until the outstanding project balance has been paid.

Access to a staging website, development URL, demonstration, screenshot, preview, or temporary account does not constitute final delivery.

9. Refund Requests

Any refund request must be submitted in writing.

The request should include the client’s name, project name, invoice or payment reference where applicable, amount paid, reason for requesting the refund, and relevant project information.

Nizwas will review eligible requests based on the agreed scope, work completed, resources allocated, expenses incurred, third-party costs, and applicable contractual/legal requirements.

Submitting a refund request does not automatically mean that a refund will be approved.

10. Non-Refundable Services & Costs

To the extent permitted by applicable law, refunds will generally not be available for:

  • Token or booking amounts
  • Completed development work
  • Completed design work
  • Approved project milestones
  • Completed SEO work
  • Completed marketing work
  • Consultation already provided
  • Project management time already used
  • Custom development already completed
  • Emergency website/security work already performed
  • Malware removal already performed
  • Performance optimization already performed
  • Maintenance services already provided
  • Hours already worked under hourly arrangements
  • Third-party purchases or subscriptions that cannot be refunded

This does not override any statutory refund or consumer rights that cannot legally be excluded.

11. Third-Party Costs

Payments made to independent third-party providers are generally subject to those providers’ own refund policies.

Examples include domain registrations, hosting, premium WordPress themes, premium plugins, Elementor licenses, stock images, fonts, APIs, SaaS subscriptions, email services, CDN services, payment gateways, advertising platforms, and other third-party products.

If Nizwas purchases a third-party product specifically for a client’s project, the cost may be non-refundable if the provider does not permit a refund.

12. Domain & Hosting Charges

Domain registration and renewal charges are generally non-refundable once processed because the registration is completed through an independent domain registrar.

Hosting fees may also be non-refundable once the service period has begun or where the hosting provider does not provide a refund.

Where Nizwas manages third-party hosting or domain services on the client’s behalf, the relevant provider’s refund terms may apply.

13. SEO Services

SEO services involve ongoing professional work and do not guarantee a particular search ranking, traffic level, number of enquiries, sales, or revenue.

Payments for SEO work already performed are generally non-refundable.

A decrease in rankings, search-engine algorithm update, competitor improvement, traffic fluctuation, or failure to achieve a particular keyword position does not automatically create eligibility for a refund.

14. Performance Marketing & Advertising

Advertising management fees relating to work already completed are generally non-refundable.

Advertising spend paid directly or indirectly to third-party platforms is subject to the relevant platform’s terms.

Nizwas does not guarantee a particular number of leads, sales, conversions, cost per lead, cost per acquisition, or return on advertising spend.

Campaign performance alone therefore does not automatically qualify a client for a refund.

15. Website Maintenance & Security Services

Payments relating to website maintenance, backups, updates, security monitoring, technical support, malware removal, Cloudflare management, or other services already provided are generally non-refundable.

If the client purchases a recurring maintenance package, cancellation conditions may depend on the billing period and terms stated in the applicable service agreement.

16. Monthly & Recurring Services

For monthly services such as SEO, website maintenance, technical support, or digital marketing, clients should provide cancellation notice before the next billing cycle where required by their service agreement.

Cancellation ordinarily stops future renewal; it does not automatically create a refund for a billing period that has already started or services already delivered during that period.

Any project-specific minimum commitment period specified in a quotation or contract will continue to apply.

17. Project Delays Caused by the Client

A client is responsible for providing required content, images, credentials, feedback, approvals, product information, access, and other project materials on time.

A project delay caused by the client’s failure to provide these materials does not constitute grounds for a refund.

Nizwas may place significantly delayed projects on hold and reschedule them according to team availability.

18. Inactive or Abandoned Projects

If the client stops communicating or fails to provide required materials for an extended period, the project may be classified as inactive.

Nizwas may attempt to contact the client before placing the project on hold.

Payments for work already completed, resources allocated, and approved milestones remain payable and generally non-refundable.

Restarting a significantly delayed or abandoned project may require rescheduling and, where the original requirements or technical environment have changed, additional charges.

19. Change of Mind

A change of mind after work has started does not automatically qualify the client for a refund.

Examples include deciding not to launch the business, hiring another agency, changing the business model, changing branding direction, discontinuing the website, or deciding the project is no longer required.

Nizwas will evaluate any cancellation based on work already completed and commitments already made.

20. Client Dissatisfaction

If a client is dissatisfied with an aspect of the project, the client should notify Nizwas and provide reasonable details about the issue.

Where the concern relates to work within the agreed project scope, we will first attempt to review and address the issue through reasonable corrections or revisions available under the project agreement.

A refund should not be treated as an automatic substitute for reasonable correction of work that can be addressed within the agreed scope.

21. Cancellation by Nizwas IT Solutions

Nizwas reserves the right to suspend or cancel a project or service in circumstances including:

  • Persistent non-payment
  • Fraudulent activity
  • Illegal activity
  • Abusive or threatening conduct toward team members
  • Serious breach of the agreed terms
  • Repeated failure to provide necessary cooperation
  • Unauthorized or unlawful use of our services
  • Requests to perform unlawful or unethical activities

Where reasonably possible, Nizwas will communicate the reason for termination.

Financial settlement will depend on work completed, payments received, third-party expenses, and applicable legal requirements.

22. Project Files After Cancellation

Where a project is cancelled before full payment, Nizwas is not required to transfer unpaid work, source files, source code, development files, designs, credentials under our control, or other unpaid deliverables except where otherwise required by law or agreed in writing.

Where the client has fully paid for completed deliverables that are contractually transferable, eligible materials may be provided according to the applicable project agreement.

23. Chargebacks & Payment Disputes

Clients should contact Nizwas directly before initiating a payment dispute or chargeback so that we have an opportunity to investigate and resolve the matter.

Fraudulent or unjustified chargebacks relating to legitimately authorized and completed services may be disputed using relevant project records, communications, approvals, invoices, and evidence of work performed.

This provision does not prevent a client from exercising legitimate rights available through their payment provider or applicable law.

24. Refund Processing

If a refund is approved, Nizwas will communicate the approved refund amount and applicable processing arrangements.

Where practical, refunds may be returned through the original payment method.

Banking charges, currency conversion differences, payment gateway charges, international transaction fees, or other non-recoverable transaction costs may affect the final amount where permitted by applicable law.

Processing times may also depend on banks and payment providers outside Nizwas’ control.

25. Force Majeure

Where a project is affected by circumstances reasonably outside the control of either party, such as natural disasters, government restrictions, major infrastructure outages, war, civil disturbances, or widespread technology failures, both parties should work in good faith to determine an appropriate revised schedule or resolution.

Such circumstances do not automatically entitle either party to a full refund for work already performed.

26. Statutory Rights

Nothing in this Refund & Cancellation Policy is intended to exclude, restrict, or override rights that cannot legally be excluded under applicable law.

Where a provision of this policy conflicts with a mandatory legal requirement applicable to a particular transaction, the mandatory legal requirement will apply.

27. Changes to This Policy

Nizwas IT Solutions may update this Refund & Cancellation Policy periodically to reflect changes in our services, business processes, payment practices, or legal requirements.

The latest version will be published on our website with an updated revision date.

Project-specific written agreements entered into before an update will continue to be governed by their applicable terms unless otherwise agreed or required by law.
